After the parties have filed their pleadings, the next step in litigation is discovery. What is discovery?
Discovery is a process whereby the parties “discover” facts that support or challenge the other party’s claims or defenses. By conducting discovery, the parties gain access to information in the possession of the other party to narrow and clarify the issues in dispute. There are many procedures for discovery, and ultimately, to ascertain the facts in preparation for trial. Examples of discovery include depositions and requests for production.
