What if there were no written or spoken terms between the parties, and the parties’ conduct do not indicate the intention to be bound?
When Boy is unjustly enriched at the expense of Girl, a quasi-contract can be formed. A quasi-contract is not a contract at all. But, a court may find that Girl can recover the benefit she has conferred to Boy. For example, if Girl only finishes painting half of Boy’s house and is unable to continue because she breaks her leg, then Girl has not performed her promise. There is no “contract.” However, a court may find that Girl can recover for whatever benefit she has conferred to Boy, the value of a half-painted house.
