What are my options when the other party breached the contract?

Depending on if the breach is material, the non-breaching party can rescind the contract, cease performance and file suit for breach or continue to perform under the terms of the agreement and sue for partial breach. However, the non-breaching party cannot cease to perform under the agreement if the breach is not a material one. If the breaching party breached by repudiation (actions or words that indicate an intention not to perform the contract in the future), the aggrieved party can accept the repudiation and sue for damages or wait for the party to perform, and sue for damages.
