What if the terms of a contract are not communicated in writing or orally?
If the parties intend to be bound by their conduct, then the parties may have an implied contract. A pertinent example these days – think about the times you pump gas into your vehicle. If Boy fills the gas tank for his Hummer with gas from Girl’s gas station, Boy implicitly agrees to pay Girl $475 (because that’s how much it would cost to fill up a Hummer today). This would be an implied contract for the sale of gasoline and the parties would be bound to perform thereunder.
