What are the levels of discovery?
There are three levels of discovery: Level 1, Level 2 and Level 3. In most cases, the parties are subject to the discovery guidelines under Level 2. Level 1 usually applies to suits where the amount in controversy is low or in divorce actions not involving children and with a marital estate of less than $50,000.00. In matters under Level 1 discovery, depositions are limited to 6 hours. Level 2 is the “default” guideline for discovery. In matters under Level 2 discovery, depositions are limited to 50 hours. Level 3 is a discovery plan specifically ordered by the court. The court decides when discovery begins, when it ends, sets the limit for interrogatories and hours of depositions.
