What can I recover if I prove a claim for tortious interference?
Upon a finding of tortious interference, you may be able to recover actual damages, exemplary damages, economic damages, pre- and post judgment interest and court costs. Attorney fees are generally not recoverable in this cause unless on some equitable grounds.
Actual damages include damages of lost benefits of the contract, personal injury in the form of lost wages, mental anguish and injury to reputation. Economic damages can be loss of profits by the plaintiff or the defendant’s profits as the result of the interference.
