What damages can I sue for breach of contract?
If the breach caused damages, the damaged party can sue for actual damages, specific performance (the acts promised under the agreement, e.g. the sale of real property), expectation interests (damages that give the aggrieved party “the benefit of the bargain by putting it in as good a position as it would have been in if the contract would have been performed.”), reliance interests (expenditures made in reliance of the promise to perform by the other party), restitution interests (money or property taken from the aggrieved party by the breaching party that when restored, would put the aggrieved party it in as good a position as it would have been in if the contract would have been performed.), liquidated damages as set forth in the agreement, and attorney fees if so stated in the agreement or if pleaded under the Texas Civil Practices & Remedied Code section 38.
