What happens if the parties do not settle?
If the case cannot settle, the case will be set for trial. The court can set the case for trial or either party can request a trial setting. Once parties decide to proceed with trial, they will try their case before a judge or jury. Where the right to a jury exists, either party may have the right to demand a jury. The decision to have your case tried before a judge or jury is dependent on many reasons. For example, if your case is comprised of particularly complex facts or issues, you may want to have a judge decide your case. In other situations, it may be more appropriate to have jurors decide the outcome of your case. Generally, this is a strategic decision that you should make with counsel from your attorney.
