What if a Defendant does not file an answer?

If no answer is filed with the court by the deadline, you can request the court for a default motion.  Keep in mind that the return of citation must be on file with the court for at least 10 days.  In Justice Court, the return of citation has to be on file for at least 3 days.  The day of filing and the day of judgment are excluded from the timetable.
