What is a deposition and who can I depose?
One party can take a deposition of another party by serving that party with a notice. Otherwise, to take the deposition of a non-party witness, you must serve that witness with a subpoena.
In a deposition, one party gives testimony as if it were being obtained in court with the same formalities. Depositions can be recorded stenographically by a court reporter whereby the parties can obtain a transcript, or by other means, including videotape.
