What is discovery and what forms of discovery are available?

Once all parties are served, the discovery period can begin.  Discovery entails a multitude of civil procedures to obtain information reasonably calculated to lead to admissible evidence in your case.  This may include serving requests for admissions, requests for disclosure, interrogatories, and requests for production or depositions.  Each form of discovery is intended to obtain different forms of information. 

For example, you may want to serve requests for productions to “discover” documents or other tangible things.  If you would like the opposing party to admit or deny the truth of a specific matter, you may want to serve requests for admissions.  In a case when the served party fails to respond to a request for admission, you may have the request deemed admitted.

Both parties are able to conduct discovery according to the designated level of discovery.
