What is “quantum meruit”?
The equitable action of quantum meruit (reasonable value) is a theory of recovery designed to prevent unjust enrichment where there exists an implied agreement for benefits received. In general, a claim for quantum meruit cannot coexist when an express contract exists that covers the services or materials in issue. The elements of a quantum meruit claim are similar to a breach of contract claim, except that the expectation for payment for goods or services were “reasonably expected” instead of contracted for expectations.
