Who do I need to serve?
If the Defendant is an individual, you must serve that individual. However, if the Defendant is a corporation, you may serve its registered agent. Domestic and foreign corporations doing business in Texas are required to designate an agent for service. Otherwise, you can serve the corporation’s president or any of its vice-presidents.
If the corporation is a foreign corporation without a registered agent, you can effectuate service by serving the Texas Secretary of State with the citation and petition. Remember to allege in your petition that there is no registered agent. For other specific requirements regarding suing a foreign entity, consult an attorney.
