What if the number of applicants and hires is really small?
If the selection rate ratio is less than 80%, but the number of individuals in issue is low (statistically invalid) then it is unlikely that any enforcement action or validity study is warranted in the absence of other evidence of discrimination. However, if the selection ratio persisted over time and becomes a pattern, validity evidence may be required.
