What is the “Uniform Guidelines on Employee Selection Procedures”?
The Uniform Guidelines on Employee Selection Procedures (43 FR 38290, et seq.) provides a series of answers to popular question that may be helpful to employers regarding the applicant selection process. These guidelines apply to employee selection procedures used in making hiring decisions, retention policies, transfer, promotion, referral, demotion, or dismissal. More specifically, these guidelines apply to employer procedures that include applicant evaluation, interviews, performance tests or probationary performance reviews. The guidelines cover employers and employment agencies. The guidelines can also apply (courts are split on this issue) government functions like licensing and certification if these functions deny persons to access to employment opportunity.
