What is a Durable Power of Attorney?

A Durable Power of Attorney allows a person the power and the right to manage your estate and your property in the event of your death or incapacitation. This person is considered you agenda and has a fiduciary duty to act in your best interest. This document is effective immediately upon your death or incapacitation without the necessity of your agent having to prove incapacitation. It is very important that you choose a trust worthy person to act as your agent as a Durable Power of Attorney gives the agent sweeping powers over your estate and over your property. A Durable Power of Attorney is always a recommend document to be generated with your Will.
