If you die without the benefit of having a Will, your property will be distributed by the state under a process called intestate succession. Under intestate succession, a Court will appoint a person who will primarily be responsible to distributing your assets, paying your bills, and in dealing with other matters concerning your estate. Prior to performing an act on behalf of your estate, the person the Court appoints will have to get approval from the Court. In addition to having to get the Court’s approval, this person will also be required to post a bond. The process of intestate succession and be very expensive and can also be very time consuming, which is another reason to have a valid Will in place.
