Who are the parties named in a Will?

Generally, the parties to a Will are the executor, guardian, trustee and the beneficiaries. The executor is responsible for collecting your property and distributing it to the beneficiaries in accordance with the wishes in your Will. In order to accomplish these goals, the Courts bestow on executors certain powers which enable them to act as if they owned the property themselves. This is why is especially important to have an executor you trust. With regard to guardians, it is their responsibility, in the event you have children, to raise your children. This is a very important decision as the guardian will be responsible for raising your children as if they were your own. A trustee is responsible for managing assets which were put in a trust and in making sure the terms and conditions of the trust are met. And finally, the beneficiaries under a Will are the parties which benefit or take property under the Will.
