If you do not have a Will and die intestate, without a Will, the State will distribute your property in accordance with the allowable standard. Generally, the assets will pass 50/50 to each side of the family. And, you will have no say as to where to where the assets go. By being proactive and responsible, you are able to control: who will get your property after death, who will be the guardians of your children, how much property or money is awarded to each person, who distributes the property, what happens in the event of a Will contest, and your can even control the cost of probate.
